In compliance with the provisions of Article 11 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights (hereinafter, LOPDGDD), PROTON informs you that the personal data you provide during your navigation and/or by filling out the forms on the WEBSITE will be processed by PROTON. The purpose of this processing is to manage the services offered. We process the information you provide as a customer and from the contact persons involved in the commercial relationship during its validity, in order to maintain the contractual and commercial relationship, carry out administrative tasks related to these services, and offer you optimal and quality service through the WEBSITE and/or the one specified in the data protection clause next to the form you have just completed.

HOW DO WE USE YOUR DATA?

At PROTON, we process the information provided by our customers in order to provide the requested services.

We use the information available to us, according to your decisions, to provide you with quality service and to ensure its proper functioning. The information provided will also be used to grant you access to and use of our WEBSITE and to provide you with information about the products and services you may desire.

Furthermore, we use the information available to us to combat harmful, suspicious conduct or violations of our terms and policies, detect and prevent spam, and maintain the integrity of our products, services, and collected data. We take the appropriate security measures based on the collected data and the purposes of processing to ensure the confidentiality and security of your personal data when it is being processed. Our entity has implemented treatment policies and security measures as required by the applicable European data protection regulations. The treatment policies and security measures implemented at PROTON are designed to prevent the alteration, loss, processing, or unauthorized use of your personal data.

We also use the information you provide to respond to you when you contact us or to communicate with you when legally permitted.

PROTON may have a presence on social media. The processing of data from individuals who follow PROTON’s official pages on social media will be governed by this section, as well as by the terms of use, privacy policies, and access regulations of the relevant social network, which have been previously accepted by the user of PROTON. We will process your data for the purpose of managing PROTON’s presence on the social network, informing you about activities, products, or services. Additionally, we will use it for any other purpose allowed by the social network regulations. Under no circumstances will we use follower profiles on social media to send individual advertisements.

By checking and accepting the corresponding box for commercial communications (check-box), the user expressly consents to PROTON sending a newsletter with updates, marketing messages, advertisements, and/or information related to our entity, the services we provide, and/or our products, as well as information about our policies and terms.

The collected data will not be processed in a manner incompatible with the purposes indicated.

WHAT INFORMATION DO WE COLLECT?

The type of information collected by PROTON depends on how you use the WEBSITE. Information about the data we collect and how to delete it can be found in the section related to the exercise of rights in this Privacy Policy.

  • We collect the information you provide when browsing our WEBSITE, specifically the identification and registration data included in forms or data and messages you communicate to us through them. This data may include your first and last name, phone number, and email address, as well as other data necessary to process your request or communication
  • We may receive identifying information when you send us an email or contact us.
  • We may currently or in the future receive identifying information when you access or log in to another page, such as a social network, from our WEBSITE. This may include text and/or images of your Personally Identifiable Information available on those third-party sites.

The RESPONSE to the forms provided to receive information about the services offered by PROTON, as well as any other questionnaire that may be provided in the future, is entirely optional. However, the refusal of the client or user to provide certain data may prevent the provision of the services offered by PROTON.

WHERE DOES THE COLLECTED INFORMATION COME FROM?

The information we collect through the WEBSITE comes exclusively from you. We do not receive data from third parties or from public access sources.

WHAT LEGAL BASIS LEGITIMATES US TO PROCESS THE COLLECTED DATA?

The legal basis for processing your data is as follows:

– The execution of the contract in which you are a party or the company you represent and PROTON, or for the application of pre-contractual measures.
– The consent provided through the express acceptance of this Privacy Policy, which you can revoke at any time. For more information on how to revoke your consent, please refer to the section related to exercising rights in this Policy.
– PROTON’s legitimate interest.
– The fulfillment of PROTON’s legal obligations.

DO WE KEEP YOUR DATA?

The personal data provided will be kept for as long as necessary to fulfill the intended purposes of processing. The duration for which we keep your data will depend on the purposes for which it is collected and the fulfillment of PROTON’s legal obligations. Data will be retained as long as the interested party does not request its deletion. For more information on how to delete your data, please refer to the section related to exercising rights in this Privacy Policy. The data obtained will be kept during the maintenance of the contractual relationship with the customer and after the termination of the relationship, until liabilities can be enforced according to current commercial and tax legislation and to comply with obligations related to the professional scope.

HOW DO WE UPDATE YOUR INFORMATION?

All information provided by the user through registration or by filling out forms on the WEBSITE must be truthful. Likewise, it is the user’s responsibility to keep all information provided to PROTON permanently updated so that it reflects the user’s actual situation at all times. The user will be solely responsible for any false or inaccurate statements made and for any damages caused to PROTON or third parties by the information provided.

We kindly ask you to immediately inform PROTON of any changes or modifications to the data you have provided, so that it is always accurate and reflects your current personal situation.

HOW CAN YOU EXERCISE YOUR RIGHTS?

In accordance with the LOPDGDD, you have the following rights:

  • The right to obtain confirmation on whether PROTON is processing personal data concerning you or not.
  • The right to request access to the personal data we hold about you.
  • The right to request correction or deletion, for example, you can request the correction of your email address if it is incorrect, or ask for the deletion of the data PROTON holds when, among other reasons, they are no longer necessary for the purposes for which they were collected. Upon deletion, we will only keep the data blocked for the fulfillment of legal obligations.
  • The right to request the limitation of processing, for example, you have the right to limit the processing of your data for marketing purposes, and you can contact us to unsubscribe from the NEWSLETTER or commercial communications. In this case, we will only keep the data for the exercise or defense of claims.
  • The right to object to processing and withdraw consent at any time, for example, you can ask PROTON to stop processing your data, without affecting the lawfulness of processing based on consent before its withdrawal. PROTON will stop processing the data, except for legitimate reasons or for the exercise or defense against possible claims.
  • The right to data portability in an automated format to another controller in cases of processing allowed by the LOPDGDD.

  • Your full name or username,
  • DNI/NIE
  • Email address
  • Right you wish to exercise
  • Information you wish to access, rectify, delete, limit processing, or exercise your right to portability

DO WE TRANSFER OR DISCLOSE YOUR DATA TO THIRD PARTIES?

The data will not be communicated or transferred to third parties, except to possible Data Processors (suppliers who provide services to our entity).

PROTON may share your information with various governmental authorities in response to hearings, court orders, or other legal processes, or for any other matter required by law. Your data will not be communicated to third parties, except for legal obligations to the Tax Agency, Courts and Tribunals, Banks and Financial Institutions for matters related to payment for services, and to our co-responsibles if necessary to fulfill the requested service.

We do not disclose your information to these Third-party Pages without your consent. However, we do not endorse and are not responsible for the privacy practices of these pages.
